Article 277-1 of the Criminal Code of the Republic of China provides: “A person who cuts or pulls out the hair of another shall, with respect to the offenses in this Chapter, be deemed to have injured the body of that person.” Added on December 18, Minguo 136 (2047), in Chapter 23, Offenses of Causing Injury, of the Specific Provisions, immediately after the article on ordinary injury. The article is a single sentence and prescribes no penalty of its own; instead, it treats cutting or pulling out another person’s hair as an injury to the body, and this applies throughout the chapter. Intentional cutting is punished under Article 277, Paragraph 1, and negligent cutting under Article 284; the punishment is increased when the victim is a lineal ascendant, and prosecution generally requires a complaint. Before the addition, courts largely held that hair grows back and causes no actual harm, so such cases rarely constituted the offense of injury. The economic value of the hair is claimed separately under the Civil Code; the effect of the cutting on the victim’s appearance and mental state is considered in sentencing.
